After we have inspected your roof and found damage that warrants a claim, a contingency agreement lets us initiate a claim with your insurance carrier with you or for you.
As the authorized contractor on your new claim, we will navigate meeting their requirements for approval on your behalf.
A contingency agreement does not obligate you to any up front payments. It merely commits you to working with us on a contingency basis. If we are unable to negotiate an approved claim and scope of work with your insurance carrier, you will owe us nothing. Otherwise, once we get your claim approved, we will present a final contract, select your shingles together, and take the initial payment at the time of contract signing.
This contingency agreement serves to direct the insurance company(s) that may be liable for this loss, in whole or in part, to Guideline Roofing & Construction, LLC, the money due in the connection with the work hereby authorized. In accordance with NORTH CAROLINA law, the insurance company must also insert the name “Guideline Roofing & Construction, LLC” on any draft(s) made as a payment for said loss. I/We agree to endorse the same over to Guideline Roofing & Construction, LLC, in the amount due. All rights to insurance proceeds relating to this authorization are assigned to Guideline Roofing & Construction, LLC.
Guideline Roofing & Construction, LLC, will complete any and all other home repairs upon approval of the insurance claim by the property owner’s insurance company. If the insurance company does not approve the claim, this contract will be null and void and the property owner shall owe nothing. The only cost to the property owner(s) will be their deductible, other than any upgrades or items not paid for by the insurance company and will be pre-approved and paid for at the property owner’s expense. Property owners shall give or endorse over all insurance proceed checks to Guideline Roofing & Construction, LLC, including any supplement or supplement payments made by the insurance company.
Guideline Roofing & Construction, LLC, is authorized to do the work outlined in the Scope of Work or (loss sheet) and approved by the insurance company incorporated by reference. By my signature below, I agree to the Terms and Conditions contained in this Agreement. I acknowledge receipt of a copy of this Agreement.
Once the insurance estimate is received, parties shall sign a contract which shall become part of this agreement and clarify exactly the work to be done. Out-of-pocket payments due or becoming due under this agreement are to be paid within TEN (10) days after the work has been completed. Insurance drafts are to be paid within TEN (10) days of receipt from insurance carrier. Payments may be ACH drafted from property owner bank account after TEN (10) days. Past due payments shall be subject to a monthly interest rate of One and a Half Percent (1.5%). If the agreement is placed in the hands of an attorney for collection or if collected by legal proceedings, I/We agree to pay any legal fees or court costs incurred by Guideline Roofing & Construction, LLC. Guideline Roofing & Construction, LLC, shall have no obligation to provide any warranty whatsoever until payment is received IN FULL.
